L'article 45 TFUE affirme "La libre circulation des travailleurs est assurée à l'intérieur de l'Union européenne ". Toutefois, cette liberté reconnue suppose, afin de l'appliquer réellement, d'harmoniser les législations des divers Etats, faute de quoi elle est illusoire. Le premier enjeu consiste à déterminer ce qu'il faut entendre par travailleur en droit de l'Union européenne et plus précisément par travailleur salarié.

This volume includes an article-by-article analysis of key instruments in European and international labour law. The book covers the whole field of labour law, ie fundamental questions, worker's mobility, equality law, individual labour law, collective labour law and dispute resolution. Editors and authors have focused on European Union law, including all of the general labour law directives and regulations, as well as instruments with a wider scope insofar as they cover labour law, eg in the field of private international law or data protection. Furthermore, the book comprises analysis of the most relevant provisions of the European Convention on Human Rights, the European Social Charter and all the general labour law conventions from the ILO.

nternational Labour Law under the Rome Conventions offers a full academic examination of the conflict-of-laws questions in Labour Law, as far as they are standardised in Europe (Rome I and for industrial action Rome II). It also deals with the unregulated or only partial regulated field of the law referring to the applicable employment law and answers detailed conflict-of-laws questions of the international Labour Law.

Cet ouvrage analyse le dispositif mis en place par la Directive Carte bleue, non pas en tant que système à part entière, mais comme partie intégrante de la politique européenne en matière d'immigration. Une telle démarche s'avère nécessaire compte tenu de l'approche sectorielle adoptée par l'UE dans ce domaine et la fragmentation juridique qu'elle occasionne. Dans ce contexte, ce travail présente une analyse des éléments essentiels et des problèmes juridiques de la Directive Carte bleue ainsi que les interactions et les liens du système avec d'autres instruments adoptés dans le cadre de la migration légale.

The EU's 'social dimension' today is a product of the ideology of the 1990s. Its employment field is directed to increase the employability of workers and the adaptability of labor market regimes. The book argues that this social-liberal approach is best explained with a set of ideas strategically advanced by 'thought communities' in the policy process. It traces the success of this new approach in the debates among academic experts and policy-makers in the mid-1990s, the decisions leading to the adoption of the Treaty of Amsterdam, and the establishment of the approach in the policy field between 1997-2007. The author explores the processes through which ideas came to matter in the policy process.

Le droit du travail de l’Union européenne s’est développé dans un domaine déjà largement occupé par les droits du travail nationaux et le droit international du travail. Pour faire ressortir les apports et les limites de ce droit, l’ouvrage prend appui sur les relations qu’il entretient, depuis l’origine, avec les droits nationaux et le droit international. The social security co-ordination forms a cornerstone of the European Union. The fact that the first regulations on the coordination of the various national systems were adopted on 1 January 1959 underlines the high importance of these issues. The EU regulations on social security have the objective of protecting those employers who make use of their right to free movement within the EU in the first place. The coordination is made difficult by the enormous social systems very different. The EU Regulations on social security provide protection for all workers and their family members who cross the internal borders of the Union, whether for professional or personal reasons.

The aim of this book is to examine how EU law relates to and impacts on the national social security systems of the Member States. It asks three key questions. Firstly, it looks at how the internal market and its developments have eroded Member States ' sovereignty over their social security systems, despite the fact that the EU has limited competence in the field. It then explores, secondly, how the Union Citizenship and, thirdly, the Charter of Fundamental Rights has affected the coordination of these regimes.

This wide-ranging and comparative text reviews the major theoretical and substantive debates on social inequality in Europe. It provides a valuable dual focus on European society and individual societies while placing Europe in its wider global context. Demonstrating the continued importance of national difference within Europe, the author argues that nonetheless the European Social Model has softened social inequalities such as those of wealth and income distribution, social class, gender and possibly even ethnicity. However these achievements are now being undermined, partially by the European Union itself.

This book analyzes the interaction of European social models, the institutions structuring labor markets' supply side, and their turbulent macroeconomic environment from the deep Europe-wide recession, ending Germanys post-unification boom, through monetary union's establishment, to the GreatRecession following the recent financial crisis. The analysis reaches two conclusions challenging the dominant view that the social models caused unemployment by impairing labor markets' efficiency in the name of equity.

The New Minorities of Europe: Social Cohesion in the European Union argues that while the EU currently faces economic issues, it is pressed with larger questions and potential problems due to the backlash against those who move freely inside the union. It uses the intra-EU migrants, particularly the Polish community who moved post-2004 into Britain and to a lesser extent Ireland, as the case through which to examine these issues. The book argues that the traditional definitions of minorities and migrants are no longer valid in the EU and we should look at all groups collectively through a continuum of social cohesion based on their ability to access rights.

The fight against social exclusion and the promotion of social justice and protection (as well as social cohesion) are confirmed to be among the aims of the EU (Article 3 TEU). Moreover, requirements linked to the guarantee of adequate social protection and the fight against social exclusion should be considered both at the level of design and implementation of EU policies and activities (Article 9 TFEU). The interaction between legal instruments and policy coordination in the field of social inclusion and social protection constitutes the theme of this book.

Focusing on posting of workers, where workers employed in one country are send to work in another country, this edited volume is at the nexus of industrial relations and European Union studies. The central aim is to understand how the regulatory regime of worker "posting" is driving institutional changes to national industrial relations systems. In the introduction, the editors develop a framework for understanding the relationship of supra-national EU regulation, transnational actors and national industrial relations systems, which we then apply in the empirical chapters.

La libre circulation des travailleurs et la libre prestation de services dans l’Union sont deux piliers fondamentaux du projet européen. Pourtant, au fil des années, ces piliers n’ont cessé de se fissurer sous les coups de plusieurs abus : concurrence déloyale entre travailleurs, fraude et abus en matière de détachement, détachements en cascade, conditions de vie des travailleurs innommables… C’est que les lois européennes mises en place pour gérer le marché du travail sont appliquées au niveau national.
